1. Introduction

SleeveFM, Inc. ("SleeveFM," "we," "us," or "our") respects the intellectual property rights of others and expects users of our platform, website, and services (collectively, the "Service") to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the “DMCA”), this Copyright Policy explains our procedures for addressing claims of copyright infringement and outlines your responsibilities as a user of the Service.

2. Reporting Copyright Infringements

If you believe that any content on the Service infringes your copyright, you may submit a notification to our Designated Copyright Agent, as detailed below. To be effective, your notification must include the following information:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
  • A description of the copyrighted work that you claim has been infringed;
  • A description of where the material that you claim is infringing is located on the Service, with sufficient detail to enable us to identify and locate the material (e.g., a specific URL);
  • Your contact information, including your address, telephone number, and email address;
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  • A statement by you, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

3. Counter-Notification Procedures

If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification to our Designated Copyright Agent. To be effective, your counter-notification must include the following information:

  • Your physical or electronic signature;
  • A description of the content that was removed or disabled and the location where it appeared before it was removed or disabled;
  • A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content;
  • Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in your judicial district, or if you are outside of the United States, the jurisdiction of the federal courts located in the State of New York, New York City borough of Manhattan, and that you will accept service of process from the person who provided the original notification of infringement.

If we receive a valid counter-notification, we may forward it to the original complaining party. Unless the original complaining party files an action seeking a court order to restrain the allegedly infringing activity, we may replace or restore access to the disputed content in 10 to 14 business days at our sole discretion.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, SleeveFM has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are determined to be repeat infringers. A user may be deemed a repeat infringer if SleeveFM receives multiple valid DMCA notices regarding that user’s content or if the user engages in other infringing conduct.

We also reserve the right to suspend, restrict, or terminate accounts for a single instance of infringement, or if we believe, in our sole discretion, that a user’s behavior presents a legal or reputational risk to SleeveFM or violates our Terms of Use.

5. Misrepresentations and Abuse

Submitting false or abusive copyright notices or counter-notices may result in account termination or other legal consequences. Under Section 512(f) of the DMCA, any person who knowingly misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys' fees.

6. Modifications to Policy

SleeveFM reserves the right to modify this Copyright Policy at any time. We will notify users of material changes by posting the revised version on the Service or through other reasonable means. Your continued use of the Service following any updates constitutes your acceptance of the modified Policy.”
